From what is cruising around as rumors, the case is going very slow but basically GW cannot claim IP to things they didn't release as miniatures. Meaning that if you include an entry in Army Book, but fail to produce miniature afterwards if someone else makes the mini and names it the same as codex entry, then GW's own mini released later is actually copyright infrigment not the other way around. Apparently that is the reason why new armies get a lot of releases in 3-4 waves within a year of Book being released and also the reason of recent releases of models missed for Space Wolves and Tyranids. But those are still rumors... :D
Anyway as a gamer I really love the stuff they do. They usually supply what market demands faster than GW does (the same goes for recent Puppetswar releases). Owning quite some collection of their bits I must say those are maybe not top-notch sculpts, but very decent gaming pieces with good casts as opposed to GW's own failcast :lol:
