Many painters copy paintings and sell the copies. I always thought that if you painted MOna Lisa and clearly stated it's just your own version/copy of the original painting - giving credits whomever you should - that you're OK with it.

If you do a cover version of a song written by someone else and sell copies of it you will be liable to pay royalties to the the song writer. The music and the lyrics are both covered by this. There are plenty of song writers out there that make a living like this without ever having recorded a song themselves!

I'm a sculptor and had some of my stuff pirated by some Brazilians so I feel pretty touchy about the subject. Unfortunately I can't do anything about it because Brazilian law is very slack on this kind of thing. It would cost a fortune to take them to court and I would probably not get anywhere anyway. You still have to pay the songwrter Royalties which are at least equal to what the band will earn.
