they are not using any of the official/licenced/trademarked iconography, that should be enough.
as long as they are not making direct copies of GW parts or using trademarked symbols, thee are not breaching the law.
why is there so many "nurgle" demons around? because GW does not have the rights to plague demons in general, only to specific plague demons with nurgle icons on it
so, sculpt something rotten, don't sculpt a copy of GW product, don't put 3 circles/skulls/flies onto your sculpt and you're safe.
this might be simplification of legal regulation, but that's how it works in general.
